General Terms and Conditions of Sale

These General Terms and Conditions ("Terms") govern the sale of products by ZM Textiles to customers through our website zmtextiles.be.
By placing an order with us, you agree to be bound by these Terms. Please read them carefully before making a purchase.
These Terms comply with Belgian consumer protection law (Book VI of the Code of Economic Law) and EU consumer rights directives.

2. Definitions
"We," "Us," "Our": ZM Textiles
"You," "Your," "Customer": The person or entity placing an order
"Consumer": A natural person acting for purposes outside their trade, business, or profession
"Products": Bedding, towels, and textile products sold on our website
"Order": Your request to purchase Products from us
"Contract": The legally binding agreement formed when we accept your Order
3. Applicability
These Terms apply to all orders placed through our website. By placing an order, you confirm that you have read, understood, and agree to these Terms.
If you are a consumer (as defined above), you benefit from mandatory consumer protection rights under Belgian and EU law, which cannot be excluded or limited by these Terms.
4. Products & Pricing
Product Information
We make every effort to display our Products accurately, including:
- Product descriptions and specifications
- Colors (note: actual colors may vary slightly due to screen settings)
- Sizes and dimensions
- Materials and certifications (OEKO-TEX®)
All Products are subject to availability. If a Product becomes unavailable after you place an order, we will notify you and offer a refund or alternative.
Pricing
All prices are displayed in Euros (€) and include Belgian VAT (21%) unless otherwise stated.
Prices are subject to change without notice, but changes will not affect orders already placed and confirmed.
We reserve the right to correct pricing errors. If we discover a pricing error after you place an order, we will:
- Notify you of the error
- Give you the option to proceed at the correct price or cancel your order
- Provide a full refund if you choose to cancel
5. Ordering Process
How to Place an Order
1. Select Products and add them to your shopping cart
2. Review your cart and proceed to checkout
3. Provide shipping and billing information
4. Select payment method
5. Review order summary and total cost
6. Confirm and submit your order
Order Confirmation
After you submit an order, you will receive an automatic email confirmation acknowledging receipt of your order. This does not constitute acceptance of your order.
A contract is formed when we send you a shipping confirmation email or when we ship your Products, whichever comes first.
Order Acceptance
We reserve the right to refuse or cancel any order for reasons including but not limited to:
- Product unavailability
- Pricing or product description errors
- Suspected fraudulent activity
- Inability to verify payment information
- Restrictions on quantities available for purchase
If we cancel your order after payment, we will provide a full refund.

Payment Processing
Payment is due immediately upon placing your order. All payments are processed securely through Shopify Payments and other certified payment providers.
We do not store your full credit card details. Payment information is handled by PCI-DSS compliant payment processors.
Payment Security
All transactions are encrypted using SSL/TLS technology. Your payment information is transmitted securely and is never stored on our servers.
7. Shipping & Delivery
Shipping Destinations
We ship to:
- Belgium: All addresses
- European Union: All EU member states
Shipping Costs
Belgium:
- Orders over €50: Free shipping
- Orders under €50: €4.95
- Free local pickup in Wezembeek-Oppem (by appointment)
European Union:
- Flat-rate €9.95 (4-7 business days)
Shipping costs are calculated at checkout and displayed before you complete your order.
Delivery Times
Belgium: 2-3 business days
EU Countries: 4-7 business days
Local Pickup: Same day or next day (by appointment)
Delivery times are estimates and not guaranteed. We are not liable for delays caused by shipping carriers or circumstances beyond our control.
Risk of Loss
Risk of loss and title for Products pass to you upon delivery to the shipping carrier.
Delivery Issues
If your order is lost or damaged during shipping, please contact us immediately at Info@zmtextiles.be or +32 488 56 42 66. We will work with the carrier to resolve the issue.
8. Right of Withdrawal (Consumer Returns)
This section applies to consumers only, as defined by Belgian and EU consumer protection law.
14-Day Withdrawal Period
As a consumer, you have the right to withdraw from your purchase within 14 days without giving any reason, in accordance with Belgian consumer law (Article VI.47 of the Code of Economic Law).
The withdrawal period expires 14 days from the day:
- You (or a third party you designate, other than the carrier) receive the Products
- For multiple Products ordered in one order but delivered separately: the day you receive the last Product
How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal, you must inform us of your decision by a clear statement. You can:

Return Conditions
To be eligible for a return, Products must be:
- Unused, unwashed, and in original condition
- In original packaging with all tags attached
- Returned within 14 days of notifying us of your withdrawal
Return Shipping
You are responsible for the cost of returning Products, unless the Products are defective or we made an error.
We recommend using tracked shipping to ensure safe return delivery.
Refunds
We will reimburse all payments received from you, including the cost of standard delivery (but not any extra costs if you chose express delivery), within 14 days from the day we receive the returned Products or proof of return shipment, whichever is earlier.
Refunds will be made using the same payment method you used for the original transaction, unless you expressly agree otherwise. You will not incur any fees as a result of the refund.
Exceptions to Right of Withdrawal
The right of withdrawal does not apply to:
- Products that have been used, washed, or are not in original condition
- Products without original packaging or tags
- Custom-made or personalized Products (if applicable)
9. Warranty & Defective Products
Legal Guarantee of Conformity (2 Years)
Under EU and Belgian law, all Products come with a 2-year legal guarantee from the date of delivery.
Products must:
- Conform to the description provided
- Be fit for the purposes for which Products of the same type are normally used
- Possess the quality and performance characteristics normal for Products of the same type
Defective Products
If a Product is defective or does not conform to the contract, you may:
- Request repair or replacement (free of charge)
- Request a price reduction
- Request a full refund (if repair/replacement is impossible or disproportionate)

- Description of the defect
- Photos of the defect (if possible)

All our Products are OEKO-TEX® Standard 100 certified, guaranteeing they are free from harmful substances and safe for human contact.

10. Limitation of Liability
To the extent permitted by Belgian law:
We are liable for damages caused by our intentional misconduct or gross negligence.
For consumers, our liability for damages is limited to the purchase price of the Products, except for:
- Personal injury or death caused by our negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under Belgian law
We are not liable for indirect or consequential damages, including but not limited to loss of profits, loss of business, or loss of data.
11. Intellectual Property
All content on our website, including text, images, logos, product descriptions, and design, is owned by ZM Textiles or our licensors and is protected by Belgian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.
12. Privacy & Data Protection
We process your personal data in accordance with the EU General Data Protection Regulation (GDPR) and Belgian data protection laws.

14. Governing Law & Jurisdiction
Governing Law: These Terms are governed by Belgian law.
Jurisdiction: Any disputes arising from these Terms or your purchase will be subject to the exclusive jurisdiction of the Belgian courts.
If you are a consumer, you may also bring proceedings in the courts of your country of residence.
15. Force Majeure
We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- War, terrorism, or civil unrest
- Government actions or regulations
- Strikes or labor disputes
- Supplier failures
- Internet or telecommunications failures
- Pandemics or public health emergencies
16. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will continue in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and ZM Textiles regarding your purchase of Products.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or legal requirements.
When we make significant changes, we will:
- Update the "Last Updated" date at the top of this page
- Notify you via email (if you have an account)
- Display a notice on our website
Changes will not affect orders already placed and confirmed.
